Kane Simons has successfully secured a settlement in excess of £525,000 for a claimant who suffered an injury in the course of her employment.
The claimant developed Complex Regional Pain Syndrome (CRPS) in her dominant arm, after sustaining direct trauma to her shoulder in an accident at work in 2013. The injury was resistant to treatment and prevented her from pursuing her intended career as a teacher.
The case involved complex issues of medical causation; the defendant denied that the CRPS was caused by the accident, attributing it to constitutional factors and to subsequent surgery which the defendant argued would have been required in any event. There was also a dispute as to the extent of any residual capacity to work, with the defendant denying any claim for future loss of earnings or loss of pension.
Prior to the settlement meeting, the defendant had offered just £55,000 to settle the claim. Kane was able to negotiate a settlement almost ten times larger.
The settlement brings the seven year case to an end and will allow the claimant to regain the financial security that was absent after the accident.
