18 St John Street’s Richard Vardon successfully defends a 65 year old coach driver charged with causing death by careless driving.
The defence case was that on a dark rainy night the deceased, wearing dark clothing and having consumed a significant amount of alcohol walked into the road providing no opportunity to avoid the fatal collision. Following the cross-examination of the Prosecution expert witness, who conceded that there may have been no fault attached to the defendant’s driving, the case against the defendant was abandoned.
The defendant was cleared on August 11 after the CPS offered no evidence.
